1. App Store and Google Play
If you got the app from the App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”) applies to the app together with these terms. If the two conflict, the Standard EULA prevails.
If you got the app from Google Play, the Google Play Terms of Service apply to your use of Google Play, including purchases and refunds, together with these terms.
2. Your licence
We give you a non-exclusive, non-transferable licence to use the app in your own work, including your real estate business, on devices you own or control, as allowed by the rules of the store you got it from. You may not:
- copy, sell, rent, lend or redistribute the app or its templates and texts as a product of your own;
- modify, decompile or reverse engineer the app, except where the law allows this despite this restriction;
- try to get around the Open House Pro purchase or interfere with how the app works.
3. Open House Pro
The app is free to download. Open House Pro is an optional one-time in-app purchase that opens several active open houses at once, the seller report (PDF), up to 5 questions of your own on the sign-in form, your logo and colour, and your own follow-up templates. It is not a subscription. It is sold and delivered by Apple or Google: they take the payment, apply taxes and show the price in your currency before you confirm. You can restore it on another device signed in to the same Apple Account or Google account, using “Restore purchase” in the app. Seeing, exporting and deleting your data never require Open House Pro.
4. Refunds
Refunds are handled by the store you paid, under its refund policy: Apple or Google Play. Your statutory consumer rights are not affected. If you need help, see the support page or email us.
5. Visitor data is yours, and so is the responsibility
The details visitors enter are stored only on your device. We never receive them. You (or your brokerage) are the data controller for them and are responsible for collecting and using them lawfully, in particular:
- giving visitors a privacy notice before they sign in. The app offers a notice template on the sign-in screen, filled in with your details; make sure it is complete and true for how you use the details;
- contacting visitors only in the ways they agreed to, and following the rules on marketing calls, texts and emails that apply to you (for example the TCPA in the United States, or in Türkiye the KVKK, Law No. 6563 on electronic commerce and the İYS message management system);
- not using your own sign-in questions to ask for sensitive information (such as health, religion or ethnicity), and not collecting details from children;
- answering visitors’ requests to see, correct or delete their details, and not keeping records longer than you need;
- keeping your device locked and backing up or exporting what you need to keep.
The privacy notice template and the ready-made message templates are offered to help you. They are not legal advice; check that they fit your situation and the law that applies to you.
6. Content and acceptable use
The app, its design, texts and templates belong to us and are protected by copyright. The typefaces and open-source components in the app are used under their own licences. Use the app lawfully and only for its purpose: taking sign-ins at open houses and following up with visitors. Do not use it to collect data without a notice, to contact people who did not agree to it, or in a way that could damage the app, other people or the stores.
7. Availability, changes and your data
We work to keep the app reliable, but we cannot promise that it will always be available, that it will work on every device or operating system version, or that it will be free of errors. We may update, change or stop offering the app or some of its features. Because we hold no copy of your data, we cannot restore data that is lost with a device or deleted in the app; use your device backup or export a CSV.
8. Our responsibility
The app is provided “as is” to the extent the law allows. We are not liable for indirect or consequential losses arising from its use. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, or your mandatory rights as a consumer.
9. Apple-specific terms
If you use the app on an Apple device:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app. Support is provided by us.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for it (if any). Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on a U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Changes to these terms
We may update these terms, for example when the app gets new features. The new version will be posted on this page with a new date. If you keep using the app after that, the new terms apply.
11. Governing law
These terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of İstanbul have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim before the courts or consumer bodies there where those laws allow it.
